IP LITIGATION AND IP TRIAL PRACTICE

Our team of registered patent attorneys are experienced litigators and trial attorneys.  We have decades of experience representing corporate clients in negotiations, litigation, and at trial in federal courts across the country.  We appear regularly at the U.S Court of Appeals for the Federal Circuit, and the U.S. International Trade Commission in Washington, D.C., and the United States Patent and Trademark Patent Trial Appeal Board in Alexandria, VA, Dallas, Texas and other USPTO regional locations.

 

We are active in federal courts on the trial and appellate level, handling patent, trademark, trade secret, copyright, and unfair competition cases.  We regularly represent and counsel clients in administrative proceedings including unfair imports investigations at the U.S. International Trade Commission, and appeals, reexaminations, and Inter Partes Review at the U.S. Patent and Trademark Office Patent Trial and Appeal Board.

 

We have trained with large and leading law firms, worked in industry, and managed successful intellectual property law boutiques. Our team excels at litigation cost containment and provides top shelf service in federal court and the U.S. PTO for a fraction of the cost of large firm competitors. The average cost of complex commercial litigation is on the order of several million dollars.  Companies large and small find the cost of rights enforcement and defense so unpredictable that litigation is difficult to justify. We are experts at achieving results that make business sense for minimal cost for established companies and for smaller companies that otherwise may be priced out of a defense or enforcement.

 

Clients sometimes prefer to pay attorney fees in litigation based on results. This allows clients to limit financial exposure, maximize predictability, and avoid runaway costs. That is why we provide alternative fee arrangements beyond the traditional hourly billing model. We leverage years of litigation and trial case management for both plaintiffs and defendants deliver results under tailored fee arrangements.  

By example, we provide traditional and hybrid hourly billing, or we can provide fixed fees and capped fees for clients that have strict legal budgets. And while not suitable for everyone or every context, clients sometimes find that they are happy to pay experienced trial attorneys a fee for a successful outcome instead of hundreds of thousands or millions of dollars for an undesirable outcome.  Accordingly, we also offer results-based fee arrangements, including pure or hybrid contingency fees.
